Welcome to Trivia Tycoon! These Terms of Service ("Terms") govern your access to and use of the services provided by Trivia Tycoon LLC ("Trivia Tycoon," "we," "us," or "our") through our website, hosted games, and mobile or web-based applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Overview of Services

• Trivia Tycoon creates and distributes live trivia games to partner bars using our proprietary software.
• Players participate in games for free using their personal devices.
• Bars (our clients) pay a subscription fee to host recurring trivia events.
• Trivia Tycoon assigns trained hosts to bars; hosts are independent contractors who may not run games independently or alter game content.
• Games are delivered to hosts at least 24 hours before the scheduled start time.

2. User Responsibilities

For Players:

• Cheating is strictly prohibited. This includes using phones, external websites, AI tools, or outside assistance during gameplay.
• Offensive, vulgar, or inappropriate team names are not allowed.
• Trivia Tycoon may warn, suspend, or permanently ban users who violate these rules.

For Bars:

• Provide adequate WiFi and venue conditions for hosting trivia games.
• Support hosts in maintaining a positive game environment.
• Honor the agreed-upon game schedule and notify us of any necessary changes at least 48 hours in advance.

For Hosts:

• Follow game content exactly as provided — no alterations, additions, or omissions are permitted.
• Maintain professionalism and ensure fair gameplay for all participants.
• Report technical issues or other problems immediately to Trivia Tycoon support.

4. Subscriptions, Payments & Cancellations

• Subscriptions are billed monthly or annually via our payment processor, Stripe.
• Invoices and payment details are managed through the bar's account dashboard or through email correspondence.
• Subscription agreements may include a minimum commitment period (e.g., 12 months) with an early termination buyout clause, as specified in the client's contract.
• Bars may cancel subscriptions at any time; cancellations take effect at the end of the current billing cycle.
• Refunds are only issued in cases where Trivia Tycoon fails to deliver a scheduled game due to our fault (e.g., no-show host or software outage with no pen-and-paper fallback).

5. Intellectual Property

• All game content, software, branding, visual materials, and formats are the exclusive property of Trivia Tycoon LLC and protected by copyright, trademark, and other applicable laws.
• Players, hosts, and bars may not copy, modify, reverse-engineer, distribute, or publicly display any part of the game content without explicit written permission.

6. Service Availability

• We strive to ensure reliable access to our Services, but we do not guarantee uninterrupted operation.
• In the rare event of a service outage, hosts may be provided with a backup version of the game to be run manually (e.g., pen and paper).
• If a game cannot be conducted due to a confirmed fault on our end, the bar will receive a credit or refund for that event.

7. Privacy and Data Use

• Trivia Tycoon collects limited personal and gameplay data, such as team names, submitted answers, feedback, and game statistics (e.g., scores and performance).
• Passwords are securely stored using industry-standard hashing techniques.

8. Limitation of Liability

To the fullest extent permitted by law:

• Trivia Tycoon shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of our Services.
• Our maximum liability for any claim shall not exceed the amount paid by the bar for the game or subscription period during which the issue occurred.

9. Modifications to These Terms

• We may update these Terms from time to time to reflect changes in law, our business practices, or feature updates.
• If changes are material, we will notify users via email or prominent notice on our website.
• Continued use of the Services after any update constitutes acceptance of the revised Terms.

10. Governing Law

• These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
• Any legal disputes will be resolved in the state or federal courts located in Los Angeles County, California.
